Welcome to More Coffee Design, INC. By hiring any of our services, you (the “Client”) agree to be bound by the following Terms and Conditions.

1. GENERAL INFORMATION, PAYMENTS, AND DEADLINES
1.1. Service Provider Identity
Services are provided by More Coffee Design, INC., a company registered in Leander, Texas, United States.
1.2. Business Hours
Our customer service and production hours are Monday through Friday, from 9:00 AM to 6:00 PM (Central Time), excluding United States federal holidays. Any request received outside of these hours will be processed on the following business day.
1.3. Payment Terms
- Upfront Payment: To initiate any project or activate a monthly subscription, 100% of the total cost is required in advance. No work will commence without payment confirmation.
- Payment Methods: We accept major credit cards (Visa, MasterCard, Amex).
- Corporate Clients: For payments via Wire Transfer, please contact us for details.
- Taxes: All published prices are plus applicable taxes.
- Chargebacks and Disputes: The Client agrees to contact More Coffee Design to resolve any billing issues before initiating a dispute or chargeback with their bank. The initiation of an unjustified chargeback will result in the immediate suspension of the account and a permanent ban from using our future services.
1.4. Cancellation and Contracts
- No Long-Term Contracts: There are no mandatory long-term contracts for our subscription services (Graphic Design, Web Design, or Social Media).
- Month-to-Month: The service is provided on a monthly basis. The Client may cancel at any time before their next billing date to avoid the charge for the subsequent cycle.
- Cancellation Responsibility: It is the Client’s sole responsibility to cancel their subscription before the automatic renewal date. No partial or full refunds will be issued for “forgotten cancellations” or lack of service usage while the subscription remained active.
1.5. Right of Termination and Suspension
More Coffee Design reserves the right to refuse service or cancel a subscription unilaterally for any commercial reason, notifying the Client in advance and refunding the prorated portion of the unused period.
However, in cases where the Client displays abusive, offensive, discriminatory, or threatening behavior towards our team, termination will be immediate and without right to any refund.
1.6. Communication Channels and Security
We accept design requests, changes, or approvals via any communication method the Client prefers (Email, WhatsApp, SMS, Phone), provided that such contact methods are duly registered under the Client’s name in our database.
- Security: For security and account protection purposes, we will NOT acknowledge requests received through new media, phone numbers, or email addresses that are not previously registered or linked to the Client’s account. To add a new contact method, the Client must request it through an already authorized channel.
2. GRAPHIC DESIGN SERVICES (SUBSCRIPTION & SINGLE PROJECT)
This section regulates specific conditions based on the modality hired by the Client.
2.1. Conditions for Subscription Model
Applies to clients with active recurring monthly plans.
- “Unlimited” Scope and Work Queue: The Client may add an unlimited number of requests to their work queue. However, our team will work on one active task at a time (or as many as the hired plan allows) sequentially. We do not guarantee a fixed amount of design outputs per day.
- Scope of Work: For a detailed list of included services, exclusions (such as 3D, advanced animation, etc.), and technical limitations, the Client must refer to our Scope of Work page on the website. By hiring the subscription, the Client acknowledges having read and accepted the limits described in said section.
- Turnaround Time: Delivery times are determined by the complexity of the requests and the daily capacity of the team. As a reference, simple tasks are typically delivered within 1 to 2 business days.
2.2. Conditions for Single Project Model (Pay-Per-Project)
Applies to individual hirings (e.g., a logo, a flyer) outside of a subscription.
- 14-Day Auto-Close Policy: The Client has a maximum period of 14 calendar days to provide feedback or request changes on any proposal sent.
- Project Abandonment: If no response is received from the Client within this 14-day window, the project will be automatically considered Approved and Finalized.
- Additional Charges: Any request for changes, adjustments, or project reactivation after this automatic closure will be quoted and charged as a new requirement or extra modification, regardless of the initial payment.
2.3. Deliverables and Archives (Common)
Applies to both modalities.
- Formats: Original editable files (AI, PSD) and viewing formats (PDF, JPG, PNG) are delivered.
- File Retention: Generated files will be available for download for a period of 6 months from their creation. After this time, More Coffee Design does not guarantee the storage or backup of the files.
2.4. Intellectual Property and Licenses (Common)
Applies to both modalities.
- Client Ownership: The Client owns full rights to the final designs created specifically for them, once the total payment has been cleared.
- Portfolio and Affiliated Brands Usage: The Client grants More Coffee Design a limited license to display the work in its portfolio, website, and social media for promotional purposes. This license extends to our affiliated brands and Doing Business As (DBA) names that are part of More Coffee Design.
- Confidentiality Exception: The above applies unless a Non-Disclosure Agreement (NDA) has been previously signed stipulating otherwise.
- Stock Elements (Third Party): If we use stock resources (photos, vectors, fonts, audio) with third-party licenses, the ownership of these elements remains with their respective creators. The Client receives a usage license but cannot resell these elements in isolation.
2.5. Error Review (Shared Responsibility)
Human error is possible. Although we strive for perfection, it is the Client’s responsibility to meticulously review every deliverable (text, data, QR codes, dimensions) before using it or sending it to print. More Coffee Design will not be responsible for costs incurred due to errors not detected by the Client during review.
3. WEB DESIGN AND DEVELOPMENT SERVICES
3.1. Service Model (Design as a Service)
Our web services operate exclusively under a subscription and maintenance model.
- Usage License: The Client acquires a usage license for the website, infrastructure, and design as long as they maintain their subscription active and in good standing.
- No Code Ownership: The Client DOES NOT own the source code or the site structure.
- Transfer Restriction: We do not deliver downloadable files, nor do we perform migrations of our designs to external servers, nor do we provide source code access (FTP/Cpanel). The service works “all-inclusive” on our servers.
3.2. Fair Use Policy
To guarantee quality and delivery times for all our clients, requests for changes or creation of new sections in the web subscription are subject to the following policy:
- Work Queue: Revisions are unlimited but processed in order of arrival.
- Daily Production Limit: The maximum volume of work processed per day is equivalent to 2 new standard sections or pages (defined as pages of up to 500 words and 3 visual content blocks). Massive projects will be divided into consecutive daily deliveries.
3.3. Suspension upon Cancellation and Grace Period
Upon canceling the subscription, the website will cease to be publicly visible, and the service will be suspended immediately at the end of the paid cycle. No site backups will be delivered upon cancellation.
- Grace Period (30 Days): After suspension, the account enters a 30-day calendar grace period during which we retain the information on our servers in case the Client wishes to reactivate the service.
- Definite Deletion: After these 30 days, all information will be permanently deleted from the server, including usage statistics, emails, client databases, payment history, and configurations. This action is irreversible.
- Reactivation: If the Client wishes to reactivate the service after this period, they must start a new subscription. This new subscription will not be eligible for the trial period or initial 14-day guarantee.
3.4. Exclusion of Downloadable Assets (Service Separation)
The Web Design service covers exclusively the interface, structure, and layout of pages visible in the browser (HTML/CSS/CMS).
- Excluded Assets: It does not include the design of materials intended to be downloaded, printed, or viewed outside the web interface, such as: Informational PDFs, eBooks, digital flyers, corporate presentations, whitepapers, or downloadable menus.
- Although these files may be hosted within the website for download, their design is strictly classified as “Graphic Design”.
- Request Method: If the Client has an active Graphic Design subscription, these materials may be requested through it and will count towards the design volume of said subscription (not as part of web maintenance). Alternatively, they may be purchased independently according to the prices published on the website.
3.5. Use of Logo Included in Web
Any logo design or identity element created as part of the Web Design package is for use solely and exclusively within the website hosted on our servers.
- No File Delivery: No file type of this logo (vector, high resolution, editable) will be delivered unless purchased through one of our Graphic Design options or corporate identity packages.
3.6. Third-Party Costs and Premium Licenses
The subscription includes the use of standard plugins and themes or those covered by our developer license. Any additional cost for specific third-party software licenses requested by the Client (premium plugins), purchase of additional domains, or paid API services (Google Maps, OpenAI, etc.) will be the sole financial responsibility of the Client.
3.7. Delays Due to Lack of Content
The monthly subscription covers the availability of our team and infrastructure. Therefore, billing continues its normal course regardless of whether the Client has delivered the texts, images, or approvals necessary to proceed. Delays in the delivery of inputs by the Client do not pause the subscription charge nor grant credit.
4. PRINTING SERVICES
4.1. Art Approval (Proofing)
More Coffee Design will send a digital proof (PDF) for authorization before printing.
- It is the Client’s exclusive responsibility to review spelling, phone numbers, addresses, and data.
- Once the art is approved by the Client, More Coffee Design is exempt from liability for errors contained in the original file.
4.2. Color Variation
The Client accepts that color variations may exist between what is seen on screen (RGB) and the printed product (CMYK/Pantone). A slight tonal variation (+/- 10%) is considered standard in the graphic arts industry and is not grounds for return or reprint.
4.3. Shipping and Damages
In the event that the product arrives damaged by the courier, the Client has a strict deadline of 24 hours after delivery confirmation by the courier to notify us at Hello@MoreCoffeeDesign.com with photographic evidence. After this time, it will be assumed that the product arrived in good condition.
4.4. Design Included in Printing (Ownership Restriction)
If the printing service quote includes the graphic design service “at no cost” or as a “courtesy”:
- Ownership and License: The design generated under this modality is and will remain the exclusive property of More Coffee Design. The Client is granted a unique usage license to view the print proof and authorize physical production.
- Physical Product Only: Since the charged cost corresponds solely to the manufacturing of the printed material, NO digital files (editables, high-resolution PDFs, or images) of said design will be delivered.
- File Acquisition: If the Client wishes to obtain the design files for personal use, digital use, or external reprints, they may do so in two ways:
1) By paying the current “Independent Graphic Design” fee, or
2) By using an active Graphic Design subscription (in which case, this release will count as a design or request within their hired workflow).
5. SOCIAL MEDIA MANAGEMENT
5.1. Scope
The service is limited to creative management, graphic design, copywriting, and post scheduling.
- Materials: The Client must provide base photographs and videos of their business.
- Use of AI and Stock: More Coffee Design may use Artificial Intelligence tools or image banks to complement content if the Client does not provide sufficient material.
- Exclusions: Does not include on-location photography/video shooting, technical management of ad campaigns (Ads Management), or payment of ad spend to platforms.
5.2. Platform Independence
More Coffee Design has no control over the policies, algorithms, or decisions of external platforms (Instagram, Facebook, TikTok, etc.). We are not responsible for account bans, content removal by the platform, or changes in organic reach.
5.3. Account Ownership and Access
The Client retains full ownership of their social media accounts. More Coffee Design will request access as ‘Administrator’ or ‘Editor’. We will never request the master password of the Client’s personal account unless strictly necessary, and it will be done through secure password management tools.
5.4. Content Approval Times
Content calendars will be sent for approval on the agreed date. If the Client does not provide approval or feedback within the following 48 business hours, More Coffee Design is not responsible for publishing delays or days without content. No refunds will be made for missed posts due to lack of timely approval.
6. LIMITATION OF LIABILITY
6.1. Warranties
More Coffee Design does not guarantee that the use of our services (Web, Graphic, or Social) will generate a specific increase in sales, traffic, or popularity for the Client’s business. Services are provided “as is” for professional and aesthetic purposes.
6.2. Indirect Damages
In no event shall More Coffee Design be liable for indirect damages, loss of data, loss of profits, or business interruption arising from the use of our services or delivered products. More Coffee Design’s total cumulative liability for any claim related to these terms, whether in contract or tort, shall in no case exceed the amount of fifty US dollars ($50.00 USD).
6.3. Force Majeure
More Coffee Design will not be liable for delays or failures caused by events beyond our reasonable control, including but not limited to: natural disasters, power outages, internet service provider failures, strikes, government acts, or pandemics.
6.4. Indemnification
The Client agrees to indemnify and hold More Coffee Design harmless from any claim, damage, or expense (including legal fees) arising from the use of materials provided by the Client (images, texts, logos) that infringe third-party copyright or intellectual property rights.
7. CONFIDENTIALITY
More Coffee Design commits not to disclose sensitive or strategic information of the Client to third parties. All shared information (accesses, business strategies, databases) will be treated with strict confidentiality and used solely for the purposes of the contracted project. Likewise, the handling of your personal data is governed by our Privacy Policy, which is incorporated into this document by reference.
8. MODIFICATIONS TO TERMS
We reserve the right to modify these terms at any time. Updates will be published on this page, and it is the Client’s responsibility to review them periodically. Continued use of the service after the publication of changes constitutes acceptance thereof.
9. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent court, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, maintaining the parties’ original intent intact. The remaining provisions shall remain in full force and effect.
10. NON-SOLICITATION
The Client agrees not to solicit, recruit, or hire directly or indirectly any employee or contractor of More Coffee Design during the term of the service and for a period of 12 months following its termination. In the event of a breach, the Client agrees to pay a placement fee equivalent to 100% of the hired employee’s annual salary.
11. JURISDICTION
For the interpretation and fulfillment of these terms and conditions, the parties submit to the laws and competent courts in Leander, Texas, waiving any other jurisdiction that may correspond to them due to their present or future domiciles.
